Term & Conditions
These Terms and Conditions ("Terms") form an agreement between Easy Motorbike (KL) Sdn Bhd, including its related parties (hereinafter referred to as "Easy Motorbike", "we", or "us") and the user (hereinafter referred to as "you" or "User") regarding the use of Easy Motorbike software and the rental of e-scooters and e-motorbikes ("Vehicle(s)") provided by us.
1. Introduction
These Terms govern your access and use of the applications, websites, content, products, and services ("Services") provided by Easy Motorbike (KL) Sdn Bhd. By using our Services, you agree to these Terms. Please read them carefully.
2. Registration
To use most Services, you must register and maintain an active account. Registration requires valid personal information including email and phone number. You agree to keep your information accurate and secure. Only one account is allowed per person.
3. Text Messaging
By registering, you agree to receive SMS for service-related notifications. You may opt out, but doing so may affect your use of the Services.
4. Promotional Codes
Promo codes may be offered at our discretion and are subject to specific terms. They are not transferable, may be revoked, and cannot be exchanged for cash.
5. License & Restrictions
You are granted a limited, non-transferable license to use the Services for personal, non-commercial purposes. You may not alter, copy, reverse engineer, or misuse any part of the Services.
6. Third-Party Services
Our Services may interact with third-party platforms. We are not responsible for their terms or services. You may also receive third-party marketing content unless you opt-out in writing.
7. User Conduct
You are responsible for your behaviour while using our Services. Misuse, illegal activity, or unsafe behaviour is prohibited and may lead to account termination or penalties.
8. Network & Devices
You are responsible for securing your own mobile data and compatible devices to access our Services. We are not liable for issues caused by device or network failures.
9. Maintenance
Easy Motorbike (KL) Sdn Bhd ensures basic upkeep of our Vehicles, but riders must inspect them before use. If damaged, do not proceed and notify us immediately.
10. Payment
Ride charges are calculated per kilometer and must be paid through the mobile app wallet or a linked payment method upon completion of the ride.
11. Refunds
Refunds for unused credit are reviewed case-by-case for transactions within 90 days. Requests must be emailed to info@easymotorbike.asia and may incur third-party fees.
12. Restricted Uses
Users must be 16+ and have the proper license. Misuse includes unsafe riding, overloading, intoxicated operation, extended use beyond 24 hours, and more.
13. Service Limitations
We may limit or suspend Services without notice, especially during weather events or by government directive. No guarantee is made for Vehicle availability at any given time.
14. Insurance
Safety is central to Easy Motorbike’s operations. All riders are covered by comprehensive rider insurance across the cities we operate in. This industry-standard coverage is provided at no additional cost, offering riders added protection and peace of mind throughout their journey.
15. Disclaimer
Services are provided "as is." We make no guarantees about uninterrupted service or specific outcomes from use.
16. Limitation of Liability
We are not liable for indirect or consequential damages except when caused directly by our proven negligence.
17. Indemnity
You agree to hold Easy Motorbike (KL) Sdn Bhd and its representatives harmless against any claims or losses resulting from your use of the Services or your breach of these Terms.
18. General
These Terms are governed by Malaysian law. We may amend them at any time. Your continued use of the Services implies acceptance of any changes.
19. User Responsibility and Liability
By using Easy Motorbike, the renter agrees to take full responsibility for the motorbike during the rental period.
* The renter is responsible for all traffic fines, summonses, parking violations, and penalties incurred while using the motorbike.
* The renter is liable for any damage, loss, or vandalism to the motorbike during the rental period, regardless of cause.
* In the event of an accident or incident, the renter must notify Easy Motorbike immediately and bear all related costs, including repairs, loss of use, and third-party claims.
* Any misuse of the motorbike or breach of these Terms will result in full liability for all resulting damages and costs.
* The renter must remove all personal belongings before ending the ride. Easy Motorbike is not responsible for any items lost, left behind, or damaged.
Easy Motorbike reserves the right to recover all applicable charges from the renter.
